The New Penal Code - An Expression of European Criminal Law

Summary/Abstract: The need for European cooperation in criminal matters determined the harmonization of the Romanian penal law with the EU's, especially by the elaboration of a new Penal Code. The ECHR sentences against Romania in penal matters have determined the inclusion of some new dispositions. This paper aims to analyze some institutions of the new Penal Code, adopted by the Romanian law-making process, that include some rules taken from the European legislation. Also we will be expressing some critical considerations on the opportunity of taking up rules from the legislations of other European states.
