Cancellation of injunction related to salary and pension overlapping for old-age pensioners under law no. 263/2010

Summary/Abstract: Law no. 329/2009 prohibits overlapping salary with pension, should the latter exceeds a certain limit, setting measures for unilateral termination of employment contracts. Upon adoption of this law, it has been stated that it is temporary, because it restrains certain constitutional rights, then there were views expressed that it is contrary to international regulations and jurisprudence of the ECHR. Law no. 263/2010 on public pension unitary system annulled injunction related to salary and pension overlapping for certain categories of people, including old-age pensioners.
