Summary/Abstract: The diversity of economic and social interactive within a more complicated society, the economic development and the increasing complexity of all day by day aspects are introducing new types of conflicts. The classical solving of a conflict by passing the authority over it to juridical institutions (justice) în order to make a decision, under the provision of the winner – looser concept, have proved not be always the appropriate approach to meet the desired outcome to all new economic and social uncertainties and difficulties.
