Summary/Abstract: Title IV of the Lisbon Treaty, entitled “Area of Freedom, Security and Justice” replaces Title IV of the Treaty establishing the European Community on visas, asylum, immigration and other policies related to free movement of persons. This title approaches matters as “Policies on border checks, asylum and immigration”, “Judicial cooperation in civil matters”, “Judicial cooperation in criminal matters”, “Police cooperation”. The present article shall analyze the legislative procedure stated by the Union’s co- legislator in the above mentioned areas, considering that if for certain mentioned policies the European Union by its institutions has legislative competence stated by the previous treaties, the Lisbon Treaty ends the supranationalism , using either the ordinary or special legislative procedure, according to Art 289 Para 1 and 2.
