North European Gas Pipeline. Legal Aspects

Summary/Abstract: The gas pipeline built on the basis of the Russian-German agreement will probably pass by the waters belonging to the Polish exclusive economic zone. By trying to influence the process of its development, Poland could use the entitlements resulting from the international law, providing it with a possibility of delaying the construction. In the years 1997–2004, no considerable importance was attached to the Russian-German project which was seen as an element of economic pressure on Poland and other transit countries—as a result the gas pipeline project was ignored. The current task is to evaluate the influence which the development of the North European gas pipeline will have on the supply of Russian gas to Poland and on the Polish demand for gas. This should provide new forecasts of gas consumption by the Polish economy and the specification of the existing strategies. Despite the lack of support of members of the European Union for the “Musketeers’ Pact,” the conceptual work on the common policy of energy security should be continued.
