International legal workshop in Bulgaria

Summary/Abstract: An International legal workshop titled: "Rights Enforcement - The Next Steps" - UNCRPD article 12 standards and their implementation in legal frameworks" was held in Sofia, on 16-17 October 2013. The Workshop was organized in cooperation between the Bulgarian Center for Not-for-Profit Law Foundation (BCNL), the Institute for the State and the Law, Bulgarian Academy of Sciences and the Bulgarian Judges' Association under the patronage of the Bulgarian National Ombudsman Mr. Konstantin Penchev The legal workshop aimed to create a space for exchange of comparative legal expertise on the implementation of the UN Convention on the Rights of Persons with Disabilities with a special focus on the supported decision making. The following presentations inspired the followed discussion on the national legal framework and the need for reform: Right to Legal Capacity in International Law - Prof. Gerard Quinn, Centre for Disability Law and Policy, National University of Ireland, Galway; Supported Decision Making as Least Restrictive Alternative: U.S. Case Law and Constitutional Perspectives - Honourable Kristin Booth Glenn, University Professor and Dean Emerita, CUNY School of Law, New York; Legal Capacity and the Duty to Accommodate - Ms. Lana Kerzner, Barrister and Solicitor, and Lecturer in Disability and Law, Ryerson University, Toronto, Canada; Practicing article 12 in daily court-decisions - mr. Yotam Tolub, Legal Advisor Bizchut - The Israel Human Rights Centre for People with Disabilities; Legal Capacity and Jurisprudence in the European Context - Ms. Aleksandra Tamamovic, Senior Legal Officer, Mental Disability Advocacy Centre. The Bulgarian presenters - Ms. Aneta Genova, Attorney-at-law, MDAC; Ms. Nadia Shabani, Program director, BCNL, Ms. Marieta Dimitrova, Legal consultant, BCNL demonstrated the gaps in the legislation and the Proposed Legal Framework for Right to Legal Capacity in Bulgaria.
