Summary/Abstract: The criticism of the traditional criminal justice system as well as the develop-ment of the restorative justice movement have generated diverse alternative models which are aimed at resolving disputes in criminal matters by “diverting” the criminal justice proceeding into a less formal yet more efficient and humane alternative pro-ceeding. One of the typical alternative dispute resolution models is the victim-of-fender mediation. Mediation has often been subject to legal regulation at the interna-tional level. For this reason, authors of this article have first focused on exploring the legal documents adopted by United Nations Organization as well as the recommenda-tions and framework decisions of the Council of Europe. Then, in the second part of the paper, they analyze legal provisions in Sweden and Austria, which can be used as illustrations of so called in-court (near-court) and out-of-court mediation. The third part is dealing with Serbian legislation.
