GENERAL PROVISIONS REGARDING THE USE OF REMEDIES IN THE DRAFT CIVIL PROCEDURE CODE

Summary/Abstract: The Draft Civil Procedure Code – whose adoption seems imminent – also contains some “general provisions” in the matter of remedies against judgments. These provisions have the significance of future guiding and configuring “principles”, so that their explanation and, if necessary, their amendment, already justifies the interest in an exegesis. This is even more relevant since, as we shall see, some of the designed regulatory sentences partially reconsider the current regulation and others are truly innovating.
