NEW CATEGORIES OF INDIVIDUALS DOING BUSINESS: LEGAL REGIME VS. ECONOMIC IMPLICATIONS

Summary/Abstract: The legal framework of the natural persons who carry out authorized economic activity was reforged through simplifying the procedures of authorisation and registering in the Trade Register, and also by establishing new categories by means of which the natural persons can carry out economic activities such as authorised natural person, individual entreprise, family entreprise. The types of liability for the assumed obligations within the mentioned categories focus on setting-up an affectation patrimony and, as a first stage, on its relation with the liability for the assumed obligations. The second stage of triggering liability takes into consideration the entire patrimony of the natural person, which will be brought action against for the obligations of the enterprise by all creditors.
