Summary/Abstract: Government subsidies to economic entities have always existed. In modern times these types of state economic intervention are now regarded as problematic when they have a significant impact on trade and competition. This has resulted in their progressively strict regulation in EU Law and their multilateral regulation under the 1994 the WTO subsidies agreement. This article examines the development and application of the substantive and procedural law of the EU concerning the regulation of “state aids”. It then reflects on some of the continuing tensions in the EU system. Finally, the content, approach and application of EU state aid rules to non- EU countries is explored with reference to the provisions of the Stabilisation and Association Agreements and their relevance to Bosnia and Herzegovina..
