Summary/Abstract: The concept of computer crime includes many varied forms of delinquent acts, more or less incriminated by some member states, the traditional type of crimes (such as theft, fraud, forgeries, etc.), as well as new types of crimes, specific to this field (unauthorized access, computer sabotage, unauthorized interception, etc.). In 1989, the European Committee on Criminal Problems of the Council of Europe elaborated a set of guidelines for national legislators, which specified the activities to be subject to criminal incrimination. The drafting of those guidelines for national legislators makes no longer necessary the adoption of a formal definition for the computer-related crime because this definition would create more difficulties than it would solve. In the analysis of functional features of activities concerned, the Committee did not attempt to give a formal definition to the computer crime, but gave to each country the task to adapt this functional classification to its own legal system and historical traditions, taking into account the crimes listed in the minimal list and in the optional list.
