Summary/Abstract: In a period when the international community gives special importance to the fundamental human rights and liberties, the principles and the rules of law ask for special attention from specialists in this field and not only. The present paperwork analyses the concept of equity in its evolution, internal determination of this concept by reporting to law, moral and other social values, the place and the role of the equity principle from the juridical point of view. In its quality of general principle of law, equity is the one who should establish a balance between the social reality addressing to and the accomplishment of the purpose followed, relationship appreciated as a functional and equitable by all the members of the society.
