ACTIONABLE PROCEDURES FOR PREVENTION OF CROSS-BORDER CRIME

Summary/Abstract: The core of a state law is the penal policy that emerges from the Parliament and is put into force by the Executive authority. Therefore, it is this penal policy that should be subject to judicial authority free of any restriction. Furthermore, the magistrate should have all the conditions to rule with full independency and impartiality within the strict limits of the law in respect to the facts and people involved in the judicial process, and without being influenced by a phenomenology which is often a simply conjectural matter.
