Current regulating solutions regarding labor law that urgently need to be amended by the legislator

Summary/Abstract: The purpose of the present study is not to judge the opportunity of one solution or of another. The following three aspects were taken into consideration: numerous interventions made by Law no. 4/2011 that are not coordinated with the system of the Labor Code; the existence of major incoordinations between the current version of the Labor Code and of Law no. 62/2011; some of the solutions prior to the intervention of 2011, which needed a series of explanations and clarifications proposed by practitioners, did not benefit the attention of the legislator; as a consequence, doctrinarian interpretations and the careful observance of the case law are still needed by the practitioners, when the respective provisions apply in labor conflict resolution. In this context, our analysis is intended to be mainly technical, providing help for those who operate closely with the application of the labor legislation. We have tried to present solutions that the current legislation permits, given the ambiguity of the legal provisions.
