Summary/Abstract: Aim of this article is clarifying the Italian “way” to face the protection approach towards linguistic minorities within its national territory. Italy is the country within the EU with the largest number of linguistic minorities, even though not always equally protected. According to the Italian Constitution, thelanguage is the basic principle under which a minority should be protected, but as important as the linguistic dimension another relevant element to take into consideration is theterritorial dimension of such protection. Nevertheless, what was not completely clear for a very long time was how to apply the Constitutional principles: turning them into a general state law or leaving the implementation to different local authorities and legal ruling bodies (Regions and Provinces)? The following article tries to analyzing the peculiarities of “the Italian case” in this respect.
