Summary/Abstract: The exposition aims to demonstrate the role of the law as a system of common rules in the social conduct and in the state’s formation. The author acknowledges that before the appearance of the state, there were already norms of law in the aspect of collective and anonymous creation. As such, they have existed not only at the beginning of the state - as it happened for the Romanians - but also later after that, until modern times.
