The Special Means of Surveillance in the Penal Code of the Federal Republic of Germany

Summary/Abstract: The struggle against modern crime is impossible without the use- of special means of surveillance. But the law must not only govern the special means of surveillance, it must give the citizens adequate guarantees against interference in their right for private life and correspondence. The Penal code must be sufficiently clear in giving the conditions for and the manner of use of the special means of surveillance, the control of their use, the limit of the duration of this secret monitoring and the empowered authorities. How all these problems are solved in the Federal Republic of Germany is the point of this research.
