Summary/Abstract: The article deals with the regulation of (CYPFA), which entered into force in New Zealand in 1989 and was a breakthrough in the jurisdiction of New Zealand. CYPFA introduced Family Group Conferences which were an alternative means to cope with young offenders (children – boys or girls under the age of 14 and young persons – boys or girls of or over the age of 14 but under 17 years). They replaced court proceedings in many cases of this kind. The professionals play no meaningful role during conferences. A youth co-ordinator convenes a family group conference and gathers its participants – the catalogue of the participants is open, a victim and an offender, offender’s family take part and any other person family group wishes. Under CYPFA, functions of family group conference are to consider, in relation to the child in respect of whom the conference was convened, such matters relating to the care or protection of that child as the conference thinks fit and to make such decisions or recommendations, and to formulate such plans in relation to that child as the conference considers necessary or desirable (Art. 258 of CYPFA). The family group conferences are convened under the principles of Youth justice, which provide that unless the public interest requires otherwise, criminal proceedings should not be instituted against a child or young person if there is an alternative means of dealing with the matter (Art. 208 of CYPFA).
