Current Status of Law Science Awareness Search and Look at Possible Future Perspectives

Summary/Abstract: The article deals with the contemporary status of law science in Lithuania and world-wide. This status cannot be conceived without the analysis of the effect of postmodernism (new science or the science of complex dynamic systems), which urges on reviewing not only the foundations of science itself, but also the scientific character of the science of law. Manifestations of postmodernism in Lithuania can be found more often, especially in the areas of philosophy, art and culture. Postmodern legal thought hardly finds its place in Lithuanian law science, though in the world postmodern ideas and new (postmodern) science of complex dynamic systems affect the science of law. Law science has still much difficulty in “separating” from modernism, which conditions the deterministic, static and narrow attitude towards science. Šiame straipsnyje nagrinėjama teisės mokslo šiuolaikinė būklė Lietuvos ir pasaulio mastu. Šios būklės negalima įsivaizduoti be postmodernizmo (naujojo mokslo arba sudėtingųjų dinaminių sistemų mokslo) poveikio analizės, kuri ragina peržiūrėti ne tik paties mokslo metodologinius pamatus, bet ir teisės mokslo moksliškumą. Postmodernizmo apraiškų Lietuvoje galime aptikti vis dažniau, o ypač filosofijos, meno ar kultūros srityje. Postmodernioji teisinė mintis Lietuvos teisės moksle sunkiai randa sau vietą, nors pasaulyje šios idėjos ir naujasis (postmodernusis) – sudėtingųjų dinaminių sistemų – mokslas daro įtaką teisės mokslui. Teisės mokslas vis dar sunkiai „išsiskiria“ su modernizmu, o tai lemia deterministinį, statišką ir siaurą požiūrį į mokslą. Manome, kad atėjo laikas keisti požiūrį į mokslą, didesnį dėmesį skirti indeterminizmui, mokslo humanizavimui, socialiniam kontekstui ir spontaniškai minties raidai.
