Summary/Abstract: The authors present an analysis of certain court decisions in relation to which the magistrates were required to answer specific issues concerning intellectual and industrial property, namely: the relationship between the right over the design and the copyright over the intellectual creation, the assessment of the counterfeiting of a design and the establishment of the prejudice.
