The methodology of defining the value of copyrights calculating the amount of restitution for legal purposes

Summary/Abstract: The recent years are the time of increase in enforcement of the laws from owning copyrights. The number of court cases related to breaking the copyrights is increasing and there appear new legal offices specializing in this area. The amount of detected cases of plagiarism in the scientific environment is growing. One of the indirect effects of this phenomena is signing of multilateral treaty ACTA. In the running court cases concerning the financial restitution for breaking copyrights there is a lack of a cohesive methodology related to calculating the restitution amount. The author describes particular methods of calculating the value of copyrights and discusses their application, exemplified by selected cases.
