The need for change in the domestic transport law

Summary/Abstract: The aim of this paper is to assess the Transport Law Act and to present its main drawbacks. The author takes a position that the act can no longer function as an act of fundamental importance to the system of the domestic transport law and should be repealed. The system of the domestic transport law should be recreated. The author presents some preliminary options of possible solutions opting for a comprehensive regulation of the contract of carriage in the Civil Code. The regulation of the Civil Code should be universally applicable to the carriage of passengers in all modes of transport. In relation to the contract of carriage of goods the provisions of the Civil Code should refer to the domestic road and rail transport. Domestic air and inland waterways transport would be subject to the regime of the relevant international conventions.
