The dogmatic and legal analyse of spousal governance of joint property of husband and wife. Part two – specific issues

Summary/Abstract: The authors of the paper looked at the institution of family law, which despite its popularity continues to produce many doubts in quite elementary aspects. Once again, an attempt to analyse the dogmatic and legal structure of spousal governance of joint properly of husband and wife was taken up. The second part of the publication covers an indication of the basis of substantive and legal solutions for the implementation of joint property management with particular emphasis on the obligation of spouses to cooperate with the management of joint property against the possibilities of its individual execution. The centre of considerations is the requirement to obtain consent and the opportunity to object to joint property management activities. Finally, the authors point to the effects of faulty governance of joint property drawing their own concept of assessing the consequences of management actions so taken.
