Summary/Abstract: The article is devoted to the analysis of the civil society`s role in the criminal justice process. The basis of the conclusions is constituted of the interview outcomes conducted by the author among 144 judges, 246 public prosecutors, 418 crime investigators and investigators, 180 lawyers as well as 2124 citizens on the territory of 18 subjects of the Russian Federation. The author proves that civil society appears only in case of existing preconditions of political, economic, cultural and social character. In other words it happens in the socially oriented state that is characterised not only by the availability of social support for all society members, principle of control and regulation of social processes, social rights of the person, social responsibility of the state, system of social protection but also by the presence of developed elements of the civil society. Herewith law in particular is the basis and foundation for the formation and development of the civil society.
