Summary/Abstract: Polish law, we are dealing with a number of restrictions of freedom to initiate and carry out the construction work. These restrictions have their source not only in civil law limits, by the existence of property rights, but also, and perhaps mainly, in the administrative and legal barriers to the whole process of locating and implementing construction projects. One of the limitations that we would like to signal in this paper, there are regulations on filling specific surface water located in the clay excavation voids. This article attempts to interpret the legal provisions relating to the process of filling the abovementioned waters. This issue is important both from the point of view of investors and public authorities applying the law.
