Acknowledgment of paternity of an adult some remarks to art. 76 par. 1 of the family code

Summary/Abstract: As a result of amendments to the regulations of the Family Code in 2008 it was adopted that “recognition of paternity may not be made after the coming of age for child” (art. 76 par. 1). Having regard to the justification for that it was assumed that only judicial decision assumes compliance between a legal paternity with a genetic paternity. Previous solutions of the Family Code had allowed a possibility to recognize the paternity of an adult child, with the consent of the child and his mother. It is worth attention if the solution adopted in 2008 is proper, referring to the previous regulations.
