ROMAN STATE-LEGAL TRADITION IN THE CONTEXT OF SERBIA'S INTEGRATION INTO EU

Summary/Abstract: On the basis of legal and historical, as well as political analysis of the development of modern Serbia, the author examines effects of the ownership structure, official ideological concepts and normative solutions upon the reception of Roman legal tradition in Serbia. Pointing to numerous paradoxes in relation to Roman Law as an academic discipline since the World War Two, he comes to a conclusion that within the European integration process the Roman legal heritage is not a burden, but an indispensable condition for Serbia’s successful participation in that global project. The author underlines that legal and political concepts of the ancient Rome are included directly and indirectly in the idea of integrating European countries in the Union. By elimination of internal borders, providing a single economic area, introducing a single currency, having a common military policy, and indirectly imposing English as a common language of all Europeans, a vast territory has been integrated to such an extent known only at the time of the Roman Empire. The author concludes that the violent disintegration of Yugoslavia was a retrograde process which, just like the process of medieval feudalization, led to the fragmentation of the common territory, disintegration of economy, and inflaming of ethnic antagonism. During that process Serbia left the European road it had already taken in the wake of its liberation from the Ottoman rule. The author believes that Serbia can succeed in its striving for European integration only if its intellectual and particularly its ruling elites find inspiration in the road already travelled. Cultural influences in Serbia have always been much more pervasive when it was economically strong and had spiritual elite capable of recognizing and accepting those processes.
