SOME CONSIDERATIONS ON THE CONCEPT OF MATRIMONIAL CONVENTION AND ITS OBJECT

Summary/Abstract: Some considerations on the concept of matrimonial convention and its object. Odată cu adoptarea Legii nr. 287/2009 privind Codul civil, legiuitorul român a ales să reintroducă convenția matrimonială, făcând astfel posibilă alegerea unui alt regim matrimonial decât cel al comunității legale de către soți sau viitorii soți. Cum legiuitorul nu a oferit și o definiție (legală) stricto sensu a convenției matrimoniale, în cadrul acestui articol ne-am propus a contura noțiunea de convenție matrimonială, precum și de a delimita obiectul specific al acesteia, fără a neglija aspectele de drept comparat prin raportare la legislația noastră.With the adoption of Law no. 287/2009 on the Civil Code, the Romanian legislator chose to reintroduce the matrimonial convention, making it possible for the spouses or future spouses to choose another matrimonial regime than the legal community. Since the legislature did not offer a stricto sensu definition (legal) of the matrimonial convention, in this article we intend to outline the concept of matrimonial convention and to delineate its specific object, without neglecting the aspects of comparative law by reporting to our legislation.
