Summary/Abstract: Law 3/2012, of 6 July, on urgent measures to reform the labor market, promoting new ways to develop the workforce. In this sense, it accommodates teleworking as being a particular form of work organization that fits perfectly in the productive and economic model pursued by this reform. On the one hand, to promote flexibility of enterprises in the organization of work. Furthermore, increasing employment opportunities and, finally, to optimize the relationship between work and personal and family life. The study focuses on determining whether telecommuting is configured as homeworking or teleworking under the provisions of Article 6 of Law 3/2012, of 6 July, on urgent measures to reform the labor market and promoting permanent contracts and other measures to promote job creation, which gives a new wording of the former Article 13 of Legislative Royal Decree 1/1995 of 24 March, approving the revised text of the Statute Law approved Workers; which is currently governed by Article 13 of Legislative Royal Decree 2/2015 of 23 October, approving the revised text of the Law of the Workers' Statute is approved.
