Opinion regarding the actions of Mr. Csibi Barna

Summary/Abstract: Police Inspectorate of Harghita County, the Criminal Investigations require NCCD point of view on the actions of Csibi Barna who exposed for marketing several clothing items that were printed images and messages in Hungarian considered to be xenophobic and incite hatred on ethnic and extremist nationalism, according to art. 2 para. (1) a) and b) of O.U.G. no. 31/2002.Given the objective pursued by Csibi Barna, message content, the context in which the right of action, Csibi Barna statements are beyond the limits of freedom of expression, containing elements of incitement to national hatred and discrimination that affect social relationships, in this case those of interethnic coexistence.This survey is a viewpoint specialist without legal obligation and is issued at the request of the prosecutor, which assuming the obligation to decide on the outcome of the criminal case and possible determination of the type of legal liability, so that a possible interference of the state in freedom of expression to meet the standards of ECHR jurisprudence.
