Summary/Abstract: The opinion is to determine whether the Inspector General for Personal Data Protection or the Insurance Ombudsman may, under the existing legal framework, hold a seat in Parliament. Formal incompatibility of the representative mandate is defined in the literature of constitutional law as a measure intended to prevent Deputies and Senators from holding other public functions or positions. The author concludes that both the Inspector General and the Insurance Ombudsman during their term of office may not be a Deputy or Senator. This does not mean that a person holding one of these functions cannot stand as candidate in a parliamentary election.
