Summary/Abstract: The purpose of this opinion is to assess the Draft Protocol on the concerns of the Irish people to the Lisbon Treaty in terms of selecting an appropriate mode of review of the Treaty and its provisions. The opinion is not aimed at assessing whether the Protocol complies with the Treaties. Such assessment is not appropriate because the Irish Protocol is to have the status of primary legislation. In the authors view, the Protocol is inconsistent and does not correspond with its title, as it provides a number of provisions relating to all Member States, not only to Ireland. Some solutions proposed in the draft do not introduce a ‘normative novelty’ that would justify their inclusion in the Protocol appended to the founding treaties.
