Summary/Abstract: The purpose of the opinion is to examine constitutionality of Article 19 of the Bill on the fundamental human rights and freedoms in the field of application of biology and medicine and the establishment of the Polish Council of Bioethics (Paper No. 3468). Therefore, the opinion is not an overall assessment of legislative correctness and legitimacy of the bill. The author claims that Article 19 of the Act is inconsistent with Articles 2 and 68 para. 1 in conjunction of Article 31 para. 3 of the Constitution because it makes it impossible to determine who is the recipient of the legal norm, i.e. the entity required and authorized by law to offer and provide services for assisted procreation. The inability to determine the recipient of this provision – also in conjunction with other provisions of the bill – introduces a disproportionate risk to public health, the health of those receiving these procedures and of the newborn child.
