Summary/Abstract: The legal opinion examines the conformity of the provisions of Article 12 para. 4 of the Act of November 9, 1995 on Health Protection against the Consequences of the Use of Tobacco and Tobacco Products with Articles 2 and 42 para. 1 of the Constitution. In the opinion of the applicant, the provision penalizing the advertising and promotion of tobacco products is contrary to the constitutional principle of nullum crimen sine lege. In the author’s view (supported by manifold arguments) the provision mentioned above does not infringe the Constitution.
