Summary/Abstract: The opinion relates to the legal and legislative correctness of the Bill amending the Act on the collection, storage and transplantation of cells, tissues and organs (Paper No 2707). The bill is aimed at regulating the issue of medically assisted procreation for the donation, procurement, processing, testing, storage and distribution of reproductive cells and embryos. The author argues that the solution proposed in the bill minimizes the legal protection of the embryo, not seeing it as a subject of rights belonging to the human person, but as an element of health services provided for recipients of assisted reproductive procedures. He claims also that the bill is not intended to adapt Polish legislation to the provisions of the Oviedo Convention, because it focuses only on some issues raised in the Convention, namely the regulation of artificial procreation issues.
