Summary/Abstract: The author of the draft submits a clarification on the legal question from the District Court for the City of Warsaw, 5th Criminal Division, of 19 October 2010 (File No. P 43/10) and applies for a declaration that Article 210 para. 1 subpara. 7 of the Act of July 3, 2002 – Aviation Law (Journal of Laws of 2006 No. 100, item 696, with further amendments) complies with Article 42 para. 1 of the Constitution. The draft deals with the issue of a “blanket provision” and the question whether this type of provision could be compliant with the Constitution. The author also examines – in this context – the conditions of use of such a legislative technique which refers to “the penalty with a relatively low potential of harm” and “the possession of democratic legitimacy”.
