Summary/Abstract: Toward the magistrate’s activity specifics, especially the judge’s one, it is natural for the society to discuss the issue of responsabilization and, finally, of magistrates’ liability. The civil liability of the magistrates signifies, concretely, in their duties, the obligation to compensate the prejudice caused by exercising their function, in certain conditions. The judge’s delictual liability is a mediated liability, through the state, and conditioned by serious negligence or magistrates dishonesty in exercising their functions.
