Summary/Abstract: This article is dedicated to investigation of the doctrine of humanitarian intervention. ln this study the author focuses on the presentation of arguments of proponents of humanitarian doctrine and its opponenls, which very well illustrates the dilemma of this theory. The supporters of the humanitarian doctrine claim to change the world order by preferring the human rights to the principle of sovereignty, which used to be one of the most elementary principles of the postwar world order. Their decisiveness to promote this new doctrine can berepresented by the activity of the lnternational Commission on Humanitarian Intervention and State Sovereignty, which was founded in September 2000 as a reaction to the intervention in Kosovo and East Timor. One of the tasks of the commission was to draft a list of criteria, which would be used as a base for decision on humanitarian intervention. This essay brings a precise examination of each of the six proposed criteria. The author as well searches for the reliable authority which should have this new norm at its disposal. Each of the suggested soůutions suffers from some form of complication, the main pros and cons are explored. ln the author's opinion the prospective legal form of humanitarian intervention would present a significant threat to international order. The existence of a legal norm of humanitarian intervention would be just another "emergency exit" from the ban of using armed forces in international relations and would indicate a great peril to current world order.
