The Penalty of Dismissal from the Clerical State

Summary/Abstract: This text presents issues concerning the canon of criminal law relating to the punishment of dismissal from the clerical state. Sources of canon law and literature in the field of canon law were used. The considerations have been divided into four parts. The first shows the manner of the loss of the clerical state mentioned in can. 290 of the 1983 Code of Canon Law, which are listed and briefly described. This section also discusses the penalty of dismissal from the clerical state provided in the directory expiatory penalties contained in can. 1336 of 1983 Code of Canon Law. This is followed by the offences punishable by dismissal from the clerical state by distinguishing the cases dealt with by the local ordinary, and those reserved the Congregation for the Doctrine of the Faith. In the next part methods of measurement of the discussed punishment are highlighted and described. The last part presents the effects of the punishment of dismissal from the clerical state.
