Summary/Abstract: Mobbing injured dignity and other personal items of mankind. It contradicts the safe and hygienic working conditions as well as the principles of social life, endangers the health and life of humans. The author defines bullying as well as all the conditions that are associated with this legal institution. In the EU accession, Poland has undertaken all the rules, including those relating to mobbing to implement. Although for many years, these rules were valid in working farms, attracting the knowledge of these problems brought on legal and interpretative doubt. The legislature undertook the employer to avoid all forms of discrimination in the workplace. Such measures should be directed to the anti-bullying prophylaxis and subsequent action. Mobbing is a special form of serious violations of fundamental obligations of the employer to the employee. Due to imprecise definition of harassment, courts have problems with decisions on such matters, which was demonstrated by the example of the judgments of the Supreme Court.
