Authorization for the acquisition of property by foreigners in Poland - selected aspects

Summary/Abstract: The aim of this paper is to describe legal issues related to the authorization for the acquisition of property by foreigners in Poland. This study was based on the provisions of law relating to the acquisition of property, jurisprudence, as well as the views of legal literature. The study begins with general issues related to the acquisition of real estate by foreigners. The paper presents the history of the development of the institutional permission to purchase real estate by foreigners and the development of regulations concerning the acquisition of real estate by foreigners. Moreover, the author analyzed the nature of the authorization for acquisition of real estate by a foreigner as an administrative decision. Another part of the study has been devoted to the proceedings on granting permits for the acquisition of real estate by foreigners. Author puts into consideration issues related to the parties involved in the issue of a permit and the institution of promise for authorization to purchase the property. In the study author presented also some of the problems of legal practice of real estate owned by foreigners, such as inheritance, prescription, or purchase of real estate by the inclusion of the joint property of the spouses.
