Summary/Abstract: Experiences that we have gained in these few transitional years are prevailing negative, but impose an additional obligation to the future, as we must, in any bankruptcy proceedings, take certain preventive measures in order to protect the archives of the creators, who had initiated bankruptcy. According to our knowledge, the preparation of the amendment of the Law on Bankruptcy, which predicted an obligation bankruptcy trustee, but also the obligation of the owner of new facilities to comply with applicable regulations that regulate the protection of archives, notably those of the cultural importance (“Official Gazette no. 71/94). This would led to more efficient operation of the Service protection of archives out of the archive and the full realization of all tasks of why this institution was founded.
