Summary/Abstract: The partners of the owners of agricultural land do not enjoy in any way a different status within the agricultural enterprises compared to other forms of association or compared to the general provisions of the common law legislation.As regards the possibilities to receive subsidies, the agricultural enterprises set‐up according to Law no. 36/1991 on agricultural enterprises and other forms of agricultural association or to Law no. 566/2004 on the agricultural cooperative, as well as the self‐employed individuals and the associations of farmers, set‐up according to law, may also benefit from guarantees granted out of the Guarantee Funds (SAPARD, European Agricultural Fund for Rural Development, European Fisheries Fund and European Agricultural Guarantee Fund).The distribution of the amounts out of the fund guaranteeing such financing, available to the Ministry of Agriculture, takes place for each fund separately, under agreements concluded by the Ministry of Agriculture with the guarantee funds.
