Summary/Abstract: The need for experimentation in medicine is unquestionable. This is an important element in thedevelopment of medical sciences, leading to more effective diagnosis, treatment and relief in suffering. Each experiment, however, involves risks that cannot be accurately predicted. It is thereforenecessary to define the boundaries of its legality. Currently, the issue of medical research isgoverned by the laws at both international and national levels and by ethical standards. The legislatorsought to ensure that involved participants have the widest possible protection, hence legalregulations lay down the rules for experimentation, govern the consent of the subjectparticipating in an experiment, impose a number of obligations on the physician in charge of theexperiment, together with the need to obtain a positive opinion of the ethics committee. Polish legislation is, however, unclear in some areas, creating room for interpretation.
