The New Tendencies of Interpretation of Article 10a of the Constitution

Summary/Abstract: Kelsen’s theory on hierarchy arrives at a conclusion that may be summarised as follows. If the hierarchy of legislation is not supplemented by implementation through administrative legal acts that are subordinated to identical legislation and to the identical executive forces, the hierarchy will be uncertain and will have to be rebuilt. Similarly, as the supporters of federalisation claim, the European Union should be restructured in a way that enables to control the hierarchy without systemic flaws.
