Summary/Abstract: On the background of the augmented European financial, banking and debt crisis, the abusive character of the contractual clauses stipulated in banking credit contracts was perceived. Whether it is a matter of interest, commissions or other types of unfair terms, costumers/consumers have begun to exercise their rights either by the administrative procedure (a referral to A.N.P.C), either by filing suits in court. In both cases, the conflict between the customers/consumers and banks forced the legislator to take initiative, enforce the application and amend the concerning legislation starting with October 1, 2013.
