Summary/Abstract: What is the main task of the legal regulation in the discovery and preservation of evidence in a criminal matter? In this paper we will try to explore how the Serbian Third Millennium adapt their criminal procedural law, criminal procedural legislation of European countries when it comes to discovering, collecting and securing evidence in criminal matters-serious crimes. In the work in accordance with his will implement the necessary volume of comparative research in several European countries, in order to reach the findings that will give us a current picture or situation in which there is a statutory criminal procedural matters in Serbia. Is it identical with the developments in European countries or not. What is it that should be changed de lege lata and de lege?
