Summary/Abstract: In order to show significant results of analytical researches studying of the constitutional and legal position of Bosniaks in the former Yugoslavia since its founding in 1918 until its dissolution in 1991, by this scientific paper we want to pay special attention to the hard-labouring and slow solving of the Bosniaks’s national issue as an autochthonous peoples in Bosnia and Herzegovina, Sandžak and Yugoslavia. By this paper, we also want to show the massive violation of fundamental human rights by non-recognizing of the Bosniaks’s national name, mother tongue, culture, religion and national sovereignty in Bosnia and Herzegovina, as the only homeland of Bosniaks. Bosniaks who were partly recognized as Muslims, they have become a constituent people in united and indivisible state of Bosnia and Herzegovina. Because of these violations of national and fundamental human rights and freedoms, the Bosniak people suffered the terrible crimes committed by the great-planners from Serbia, Croatia and Montenegro during all wars in Bosnia and Herzegovina led in the 20th century. In this way we want to show that the constitutionality of Bosniaks, Croats and Serbs in Bosnia and Herzegovina is not Dayton construction, but it was found the formula for recognition of the Republic of Bosnia and Herzegovina during the first session of ZAVNOBiH as an equal federal unit in the Democratic Federal Yugoslavia, i.e. in Federal National Republic of Yugoslavia.
