Summary/Abstract: The meaning of the term „breaking the law” depends on the syntax of the law text. There are taken into account two hypothesis: 1) the law suppose an implication from fact to punishment; 2) the law assumes an equivalence between fact and punishment. In both cases, the responsibility for the breaking of the law is shared between the offender and judge. The latter cannot be absolved of guilt for violations of the law.
