SOME NOVELTIES IN LAW ON MANDATORY INSURANCES IN TRAFFIC OF REPUBLIC OF SRPSKA

Summary/Abstract: The new Law on Mandatory Insurances in Traffic has been announced on 6th October 2015 in Official Gazette of Republic of Srpska. It came into force on 14th October 2015. On territory of Federation of Bosnia and Herzegovina (FB&H) there is still in force the Law on Liability Insurance for Motor Vehicles and other Regulation on Mandatory Liability Insurance from 26th April 2005, that was announced in Official Gazette of Federation of B&H no. 24/05. This Law is almost identical as the same named Law of Republic of Srpska (RS) which was effective on territory of RS until the new Law entered into force. In FB&H the finishing of procedure of deregulation and beginning of liberalization of mandatory motor insurance is just forthcoming. Working on new regulation is ongoing and inevitable change of law in insurance branch, along with beginning of application of liberalization on insurance market, are necessary traces in next few years. The significant part of new Law on Mandatory Insurances in Traffic in RS is in compliance with requests from Stabilization and Association Agreement signed between Bosnia and Herzegovina and European Union, as well as with EU Directives that regulate mandatory insurance in traffic. The most important changes brought by new Law on Mandatory Insurances in Traffic of RS that are topic of this article are in its chapters that refer to the following issues: collecting of information and documentation related to a traffic accident; commencement, expiration and territorial scope of contract on motor third party liability (MTPL) insurance; procedure of settlement of compensation claims submitted on basis of MTPL insurance policies; subrogation rights of insurance companies; amounts of sums insured; regulation on appliance of European Accident Report; regulation on supervision and penalties.
